AUCTION TERMS & CONDITIONS OF SALE: PLEASE READ ALL TERMS BEFORE BIDDING. PLACING A BID CONSTITUTES FULL AND COMPLETE ACCEPTANCE OF ALL TERMS AND CONDITIONS OF SALE. King Galleries, Inc is acting as agent for the consignor or owner of the items in the auction.
1. All items sold AS IS WHERE IS and all sales are final. All lots are sold with no guarantees of any kind, with all faults, imperfections and errors of description, regardless of statement of condition made from the auction block. Buyers shall rely entirely on their own inspection and information. We strongly encourage in person inspection of any and all lots in the auction. King Galleries is not responsible for genuineness or authenticity of any lot. Catalog descriptions are provided as a courtesy and are made to the best of our ability. No warranty whatsoever is given by King Galleries. No credits or refunds shall be given. King Galleries has full discretion to refuse any bidding, to divide any lot, to combine any two or more lots and to withdraw any lot from the sale without giving reason or notice.
2. Bidder is responsible for knowing which item he/she is bidding on. If unsure, bidder should inquire or refrain from bidding. If you become the winning bidder, you have entered into a contract and are expected to pay for the item(s).
3. Payment is due in full within 5 business days of the date of sale. King Galleries will email (to address provided on LA account) successful internet bidders an invoice within 48 hours of the end of the auction. If you do not receive an invoice within 48 hours, please contact the Gallery directly at 1-770-998-1618 to confirm email address.
4. All merchandise must be picked up within 15 days of the date of sale. Items left beyond 15 days after the sale are subject to a $10 per item per day fee. Any storage fees accrued must be paid prior to item being picked up. Items left after 90 days will be considered abandoned and title will transfer to King Galleries, Inc. Any item(s) left beyond 90 days may be re-sold at King Galleries discretion, without further notice. No refunds or credits will be given. 4a. UPDATED SHIPPING 2024: In-House shipping available on select items through our 3rd party shipping partners. Bidder is responsible for ALL costs associated with shipping and will pay 3rd party shippers directly. Ultimately, buyer is responsible for all aspects of shipping and may elect to arrange their own shipping or may pick-up their item in person. Certain items including larger format or overweight items are EXCLUDED from in-house shipping. King Galleries is happy to provide a list of 3rd party shippers that can assist with these items. Once invoice has been paid, unless King Galleries has been notified of alternative shipping arrangements or local pick-up is elected, we will forward your invoice to the shippers to provide a quote to pack and ship your auction item(s). If you would like to request a shipping quote PRIOR to the auction date, please email KingGalleries@Bellsouth.net to request a shipping quote. King Galleries assumes no responsibility for the choice of shipper or the handling of the shipping company, regardless of whether or not King Galleries provided the name of the shipping company.
5. The successful bidder is subject to any applicable sales tax as determined by their local city and/or State jurisdiction. King Galleries will collect and remit sales tax in states where nexus has been established and where we are legally required to do so. In-State Georgia bidders are subject to a 7.75% Georgia sales tax unless a valid resale number is provided and proper form completed and submitted to King Galleries prior to payment of invoice. Out of State wholesale purchasers must provide a valid tax-exempt certificate and complete a sales tax exempt form to the Auction House prior to paying invoice in order to be tax exempt.
6. A buyers premium will be applied to all auction purchases. For In-house, in-house absentee and in-house phone bidding, the buyers premium is 18%, discounted 3% for cash or good check payment. For in-house internet bidding through King Galleries website bidding platform the buyers premium is 20%. For internet bidders on all 3rd party websites such as Live Auctioneers and Invaluable, the buyers premium is 23%, regardless of payment method.
7. The absence of a condition report does not mean the item is free of damage or defects. It is the buyer’s sole responsibility to inspect and/or preview all lots prior to auction and/or to request a condition report prior to sale. Items sold are often of some age. If you are unsure of the condition, please refrain from bidding as ALL lots are sold AS IS and by placing a bid in the auction, bidder is accepting item in as sold condition.
7a. Chandeliers offered are often of some age. We strongly recommend a licensed electrician inspect any light fixtures (lamps, chandelier, etc.) prior to having them installed. King Galleries accepts no responsibility for the wiring or lack of wiring of any light fixture.
8. We accept the following methods as payment for U.S. auction purchases: American Express, Visa, MasterCard, & Discover, Cashiers or Certified checks and wire transfer. Cash is accepted for in person payments only. There will be a $30 returned check fee for any and all check payments that are returned. There is a flat $15 fee for domestic wire transfers and $16 fee for international wire transfers. International payment by wire transfer ONLY. WE DO NOT ACCEPT PAYPAL.
9. Absentee, phone and internet bidding are offered as a courtesy. King Galleries accepts no responsibility for a missed bid or withdrawal of any lot for any reason, with or without notice.
9a. NOTICE TO INTERNET BIDDERS: The internet platforms are INDEPENDENT of each other. Bids placed on one website WILL NOT reflect on the other websites. It is bidder’s sole responsibility to check each site when leaving bids, whether absentee or live. Auctioneer has full discretion in the event of a tie bid and will recognize the bid that he/she sees first. Therefore, it is possible for an item to sell to a competing bidder at the exact bid left by another bidder. For example, if one bidder leaves a bid of $1000, but the auctioneer receives a competing bid for $1000 at the same time, the auctioneer may recognize the competing bidder and the item would sell at that bid to the competing bidder, if there are no advances.
9b. King Galleries has full discretion on bidder approvals. If you place a bid in the catalog and your registration is not approved, your bid will not be submitted. First time bidders with our Gallery may be asked to provide additional information. Failure to provide the information in a timely manner may delay the approval process.
10. Auction catalog items are described to the best of our ability and knowledge and are subject to change. King Galleries is not responsible for errors of description. Auctioneer reserves the right to make verbal corrections at the time of sale.
11.Upon the fall of the hammer (the auctioneer said sold), the title and responsibility for each item or lot passes to the purchaser. In the case of a disputed bid, the auctioneer, at his or her sole discretion, will determine the successful bidder or may re-offer and re-sell the article in dispute.
12. King Galleries reserves the right, at it’s sole discretion, to refuse admittance to the premises or to refuse bidding on any lot, with or without notice.
13. Submitting any bid on any item constitutes bidder’s acknowledgment and acceptance of all terms and conditions of sale. In the event a bidder refuses to comply with any terms of sale, including failure to pay for any item, King Galleries has the right to pursue all legal remedies available under the laws of the State of Georgia.
