Conditions of Sale
AUCTION TERMS & CONDITIONS OF SALE: PLEASE READ ALL TERMS BEFORE BIDDING. PLACING A BID CONSTITUTES FULL AND COMPLETE ACCEPTANCE OF ALL TERMS AND CONDITIONS OF SALE.
1. All items sold AS IS WHERE IS and all sales are final. All lots are sold with no guarantees of any kind, with all faults, imperfections and errors of description, regardless of statement of condition made from the auction block. Buyers shall rely entirely on their own inspection and information. King Galleries is not responsible for genuineness or authenticity of any lot. Catalog descriptions are provided as a courtesy and are made to the best of our ability. No warranty whatsoever is given by King Galleries. No credits or refunds shall be given. King Galleries has full discretion to refuse any bidding, to divide any lot, to combine any two or more lots and to withdraw any lot from the sale without giving reason(s).
2. Bidder is responsible for knowing which item he/she is bidding on. If unsure, bidder should inquire or refrain from bidding. If you become the winning bidder, you have entered into a contract and are expected to pay for the item(s).
3. Payment is due the day of sale for in-house bidders. For internet, absentee and phone bidders, payment in full is required within 5 business days of the date of sale. King Galleries will email (to address provided on LA account) successful internet bidders an invoice within 48 hours of the end of the auction. If you do not receive an invoice within 48 hours, please contact the Gallery directly at 1-770-998-1618 to confirm email address.
4. All merchandise must be picked up within 15 days of the date of sale. Items left beyond 30 days after the sale may be charged a $10 per item per day fee. Any storage fees accrued must be paid prior to item being picked up. After 90 days, item(s) may be re-sold at King Galleries discretion, without further notice. No refunds or credits will be given.
4a. Shipping is the sole responsibility of the purchaser. King Galleries assumes no responsibility for the choice of shipper or the handling of the shipping company, regardless of whether or not King Galleries provided the name of the shipping company.
5. All sales are subject to a 7% Georgia sales tax unless a valid resale number is provided and proper form completed and submitted to King Galleries prior to payment of invoice or item(s) are shipped out of state by common carrier and bill of lading is provided.
6. A buyers premium will be applied to all auction purchases. In-house buyers premium is 15%. For all internet bidders, the buyers premium is 18%.
7. The absence of a condition report does not mean the item is free of damage or defects. It is the buyers sole responsibility to inspect and/or preview all lots prior to auction and/or to request a condition report prior to sale. Items sold are often of some age. If you are unsure of the condition, please refrain from bidding as ALL lots are sold AS IS and by placing a bid in the auction, bidder is accepting item in as sold condition.
7a. Chandeliers offered are often of some age. We strongly recommend a licensed electrician inspect any light fixtures (lamps, chandelier, etc.) prior to having them installed. King Galleries accepts no responsibility for the wiring or lack of wiring of any light fixture.
8. We accept the following methods as payment for auction purchases: American Express, Visa, & MasterCard, Cashiers or Certified checks. Cash is accepted for in person payments only. WE DO NOT ACCEPT PAYPAL.
9. Absentee, phone and internet bidding are offered as a courtesy and King Galleries accepts no responsibility for a missed bid or withdrawal of any lot for any reason with or without notice.
9a. Notice to internet bidders: Auctioneer has full discretion in the event of a tie bid and will recognize the bid that he/she sees first. Therefore, it is possible for an item to sell to a floor bidder at the exact bid left by an internet bidder. For example, if an internet bidder leaves a bid of $1000, but the auctioneers receives a floor bid for $1000 at the same time the internet bid comes across, the auctioneer may recognize the floor bidder and the item would sell at that bid to the floor bidder if there are no advances.
10. Auction catalog items are described to the best of our ability and knowledge and are subject to change. King Galleries is not responsible for errors of description. Auctioneer reserves the right to make verbal corrections at the time of sale.
11.Upon the fall of the hammer (the auctioneer said sold), the title and responsibility for each item or lot passes to the purchaser. In the case of a disputed bid, the auctioneer, at his or her sole discretion, will determine the successful bidder or may re-offer and re-sell the article in dispute.
12. Submitting any bid on any item constitutes bidders acknowledgment and acceptance of all terms and conditions of sale. In the event a bidder refuses to comply with any terms of sale, including failure to pay for any item, King Galleries has the right to pursue all legal remedies available under the laws of the State of Georgia.

PLEASE READ TERMS AND CONDITIONS set forth by A CLASS ACT AUCTIONS which will be a binding contact between serious buyers, winning bidders and A Class Act Auction.
Upon bidding in our online auction, you acknowledge and hereby agreed to be obligated by all of the TERMS AND CONDITIONS set by A CLASS ACT AUCTIONS. All items listed and described by A Class Act Auctions to the best of their knowledge that the information presented in the listing is solely to the convenience of the buyer. A Class Act Auction does not give any assurance with the marketability and condition of the lot relating to value either impress or implied. A Class Act Auctions has the right to accept or reject bid for any reason whatsoever. It is the bidder's responsibility to check veracity, determine condition, age, genuineness, value or any determinative factor of the item prior to bidding by contacting the auction house either through email: sandy@aclassactauction.com or through our customer service and ask for details of the lot before placing any bids as bidder agrees to accept the lot being bid with no objection after the sale closed.
Any bid placed is a BINDING CONTRACT.
ALL SALES ARE FINAL, STRICTLY NO RETURNS, NO EXCHANGES NOR CREDITS. All lots are sold "AS IS" without RECOURSE ON ALL LOTS/ITEMS. AUCTION/BUYER'S PREMIUM IS STRICTLY NON-REFUNDABLE. It is solely the bidder's responsibility to check, determine, evaluate and inspect specification of each lot prior to bidding. Descriptions, illustrations and portraits are not guarantee, no assurance nor warranty.
PAYMENTS:

Once the invoice has been sent out you only have 5 business days to pay or the item(s) are subject to go into another auction. If you are going to be out of town you must call A Class Act Auction to advise of return date otherwise your items are subject to go into another auction.
SHIPPING, HANDLING & INSURANCE
All packages are being ship through USPS and FEDEX. SHIPPING TIMEFRAME is 7-10 business days. Winning bidder is responsible to pay the shipping and handling charges. Shipping fee is added in the final invoice. Shipping charge depends on the value and weight of the package. A Class Act Auctions insures packages while it is in transit to the winning bidders.
All domestic packages within the U.S. minimum shipping charge is $10.00 (package value of $100 and below)
Minimum international shipping charge is $40.00 (package value of $200 and below)
International packages may be subject to their respective country's customs, duties and taxes and bidders are responsible to pay this charge. A Class Act Auction is not responsible in paying your customs, duties and taxes. Please make sure to update the auction house if there are any changes in your shipping address. A Class Act Auction only based the shipping address listed your profile. Please note that as the value of the package goes up shipping charges go higher as well. Please contact auction house if you want quotation of shipping charge.
SUCCESSFUL BIDDERS
All successful bidders will receive an invoice via email listed in their profile within 5 days after end of the auction. Please make sure that your email address is correct in your profile. Invoice includes all winning items amount, 15% Buyer's Premium, Shipping Charge and IN TAX (for all Indiana residents).
Bidders are responsible to pay their invoice and failure to do so will entail any of the combination of measures: elimination for all future auctions from the hosting site, credit agency reporting and legal collection agency.
CANCELLATION OF WINNING ITEMS
All sales are final as the bidding close and once declared as winning bidder for a particular item. A Class Act Auctions will not be responsible for any errors or missed bids from any source from bidders' end. A Class Act Auction does not tolerate testing of system such as bid testing, internet service failure due to power outage, any interruptions or technical errors before or during online auction. Winning bidder is responsible to pay 50% of the winning amount as the cancellation fee to cover the auction house fees to re-list your winning item.
Here at A Class Act Auction we are only human and we do make mistakes. We will work through them and if at any point you become verbally abusive we hold the right to cancel your order and items will be resold.
